The Gaming Flashback this week is the Activision racer The Great American Cross-Country Road Race, while this week’s Gaming History doesn’t focus on a video game company or developer, but a fictional character instead, Mario’s favorite mount, Yoshi.
The news this week includes:

EA forum bans cause game bans

GOG sez customers hate DRM
Steam user database cracked
Uncharted 3 launches with 1.1M sold in first week

They’ve begun a petition to try to convince Sony to let the MMO live on as a free-to-play MMO.

The petition asks Sony to convert the game to a ‘freemium’, microtransaction-based MMO, and that Sony consolidate players onto a smaller number of servers and facilitate character transfer to reduce operational costs in order to keep the game running. The petition has already gotten thousands signatures in a few days.

One of the petition leaders posted:

We are not your typical gamers.

We are not a commodity.

But if you look at the recent decision by Lucasarts to shut down Star Wars Galaxies, you might be inclined to think we are both of those things. Lucasarts thinks that we are a non-perishable commodity that can be shoved into a shipping crate and moved down the road to their next project. That is not the case. Not even close.

We are a vibrant community. We have seen our ups and downs, but we are only stronger because of it. We have endured all manner of broken promises and misleading “improvements” to this game, and throughout all of it, we have continued to build our community, and show support and loyalty to this great game. But we didn’t do it because of a game. We did it because of our community here.

No matter how hard you try, you can never apply any sort of label or definition to the players of Star Wars Galaxies. Unfortunately, it seems like Lucasarts is doing just that by assuming we will simply shuffle over to their next product simply because it contains the words “Star Wars” in the title. But oh, that is so far from the truth. We are not your typical gamers, and we are not your typical Star Wars fans. In fact, both of those truths are the very things that make our community so strong.

The world is obsessed with trying to apply labels to groups of people, and will often do so on the basis of pure assumptions and hearsay. You can’t do that with Star Wars Galaxies players. We are not some geeky group of people who simply want to log into a video game and shoot battle droids and fly spaceships with laser guns.

Many of us are highly educated. Many of us have children and families. Many of us have great careers.

Just the other day I learned that a great player on my server of Starsider was once the mayor-elect of his city in Canada. And what’s more, he was 18 years old. I have known a concert violinist, a fireman, a surgeon, a newspaper editor, an EMT, a helicopter pilot, and on and on and on. And all of these people I met through Star Wars Galaxies.

On top of all that, many Star Wars Galaxies players are active service military personnel. I remember once talking to a member of my guild and having him tell me he was logged into Star Wars Galaxies from his base in Iraq. Without a moment’s hesitation, I got his unit’s mailing address and sent him and his comrades a care package. Star Wars Galaxies made that connection possible.

So much happens because of Star Wars Galaxies that goes unnoticed. This is much more than a game to the people who play it. It’s our community. And a community is not a commodity, so don’t be surprised when we want nothing to do with the people who are trying to force us to give up our community just so they can make a few extra bucks.

Sony has apparently not responded well to this “insurgency”, and have started locking any topics referring to the petition. Despite this, the campaign has spread like wildfire among the Star Wars Galaxies community and is beginning to take over the game’s official Facebook page.

Hilariously, Sony has said ”promoting an online petition causes disruption within the community and does not provide gameplay feedback that our development team can use.” What development team, if you’re shutting the MMO down?

Several players have emailed VentureBeat stating they’re joining a class-action lawsuit against Sony shutting down the petitions; one player said that Sony pegged him as a “ring leader” in the protests and threatened to permanently ban him from its games andfile criminal charges against him for trying to cause ”unlawful harm to the company.” Saywhat?

Sony can do whatever it likes on its forums, of course, since the EULA is in effect. Of course, petitions being “unlawful harm” is equally ridiculous. You’d think after SOE got hacked, with Sony remaining mum about it for a while would make people cautious about dealing with the company.

Ken Johnson, an aide to subcommittee chairwoman Mary Bono Mack (R-CA), told The Atlantic Magazine that Tim Schaff, president of Sony Network Entertainment, would testify before the subcommittee next week:

“While Chairman Bono Mack remains critical of Sony’s initial handling of the data breaches, she also is appreciative that the company has now agreed to testify. The Chairman firmly believes that the lessons learned from…the Sony…experiences can be instructive and guide us as we develop comprehensive data protection legislation. We expect to introduce that legislation, which will provide new safeguards for American consumers, in the next few weeks.”

Previously, Sony’s Kaz Hirai had only sent his testimony in a letter to the Committee.

Professor Bill Caelli told newspaper The Australian, “Why is it that in the IT industry enterprises certify themselves?” said Caelli, noting that PSN didn’t have the same restrictions, and added that the public has “no way of assessing the assurances given by the owners of the (PSN) system themselves”.

Reportedly, Australian privacy commissioner Timothy Pilgrim has been in contact with Sony, and has not judged yet whether Sony has given them enough information to restore PSN. His investigation will be an ongoing one as well, even after PSN is restored.

When it was discovered user information had been stolen during the PSN breach, the Australian federal government announced plans for a law forcing companies to disclose privacy breaches, although it was unclear when it might come into effect. Privacy minister Brendan O’Connor had stated:

“Sony isn’t alone. We’ve seen serious privacy-related incidents in recent months involving other large companies. All companies that collect customers’ personal information must ensure that the information is safe and secure from misuse.”

We’ll stay on this story as it develops.

Nearly its entire portfolio of online games, game forums and Web sites will go back online but the company will also require players to reset their passwords.

Sony states:

As the result of a criminal cyber-attack on the company’s network, SOE shut down its game services in order for the company to undertake an investigation and incorporate rigorous enhancements to the overall security of the network infrastructure. SOE worked with several outside respected security firms during the course of implementing significant security measures that strengthen safeguards against unauthorized activity and provide customers with greater protection of their personal information.
SOE made enhancements to overall data security as well, including updating and adding advanced security technologies, additional software monitoring, performing new penetration and vulnerability testing, and increased levels of encryption.

“Our main priority is the safety and security of our customers’ personal information,” said Kazuo Hirai, Executive Deputy President, Sony Corporation. “We are making consumer data protection a full-time, company-wide commitment, and have applied enhanced security technologies so that our customers can feel protected and confident about playing our games.”

Hirai added, “We are committed to delivering secure and entertaining games for players of all ages and thank each of our players for their patience and support during this difficult time.”

SOE will also be offering its customers a “Welcome Back” program that includes special game content and services to all registered Station Account holders. As part of this program, players will receive 30 days of additional game time plus one day for each day SOE’s services were down.

The first phase for North America and Europe includes:

Sign-in for PlayStation Network and Qriocity services, including the resetting of passwords.

Restoration of online gameplay across PlayStation 3 and PSP.

Playback rental video content, if within rental period, of PlayStation Store Video Store on PS3, PSP and Media Go.

Music Unlimited, for current subscribers, on PS3 and PC.

Access to third party services such as VidZone and MUBI.

Friends’ category on PS3, including Friends List, Chat Functionality, Trophy Comparison, etc.

PlayStation Home.

“In the first week of downtime we did not really see any major change in sales or trades,” says one source, a store manager at a major UK retailer speaking on condition of anonymity. “However from the second week onwards we have seen an increase of over 200 per cent on PS3 consoles being traded in, split almost 50/50 between those trading for cash and those taking a 360 instead.”

Another UK source has reported that the independent retailer had seen a “massive increase” in the volume of PS3s traded in in recent weeks, and has pegged the biggest trade-in demographic as “the hardcore online shooter crowd”, who are logically the group most likely to defect when their online gaming is wiped.

Belgian-based Gameswap spokesman Tom Mestdagh went on record to state, “At the end of each month people come to sell their consoles. People that need money (to pay bills). What’s different this time around is that that they are bringing in PS3s together with all their games and they don’t want money, they want an Xbox 360. In every case it is because of Black Ops and or Modern Warfare 2.

“We’re just ten days into the month and already we have an increase of 200 per cent in PS3s coming into the store compared to all of March. Normally we sell them really fast, but not this time. We’ve only sold 30 to 40 per cent of our inventory right now.”

Game purchases have also been markedly affected by the PSN outage. Sales of Call of Duty: Black Ops went from 44% for the PS3 in the first two weeks of the game’s release to 24% of sales of Black Ops last week. Similar trends have struck games like FIFA 12.

Another retailer told Edge:

“A lot of people have been phoning asking us about personal details on PSN as they are struggling to get a response from Sony themselves. Overall, people that have traded with us seem annoyed at how Sony has handled all of this, and say they would not trust them with details again in the future.”

However, it’s all about online gaming. “All we’ve seen is an incredible amount of disgruntled people annoyed that they can’t play online,” stated Mestdagh, and gamers have actually “stopped complaining about the fact that Microsoft charges for Xbox Live. It used to be a big problem for most of our PS3 customers.”

You get what you pay for.

In a letter addressed to PlayStation executive deputy Kaz Hirai, the Subcommittee on Commerce, Manufacturing, and Trade has prepared a list of questions related to the intrusion; the list can be downloaded from the New York Times here. The letter asks several questions that Sony has not disclosed to the public, such as:

How many PSN users had a credit card on file

Why Sony cannot determine if credit card was stolen.

What are Sony’s plans towards increasing its security in the future.

The Subcommittee’s press release states:

“Given the amount and nature of personal information known to have been taken, the potential harm that could be caused if credit card information was also taken would be quite significant. The Subcommittee on Manufacturing, and Trade has a longstanding interest in consumer privacy, identity theft, and industry efforts to address threats posed by unauthorized access to consumers’ personal information resulting from a data breach.”

The Subcommittee is requiring a reply by no later than May 6, as part of a privacy driven effort “to protect consumer information.”

Meanwhile, Kaz Hirai will be holding a press conference tomorrow from Sony Japan, to address the PlayStation Network hacking crisis.

The conference will be held at 2PM Japan time, which means a lovely 12 midnight time for those in New York and 5AM the next day for those in London.

It is expected that Hirai will announce a new PlayStation Network security system, and when PSN will be live for users to enjoy. He also may announce what sort of compensation Sony will offer.

As for PSN itself, the service is still down, but Sony has already stated that the service would return sometime around May 3. For the last two weeks, PlayStation Network has been down, and worse, personal data was exposed, including millions of debit card data. In fact, some underground sites have begun sellingwhat they claim are 2.2M credit card info, though the claims could be fraudulent or worse, propagating computer worms or viruses.

Regardless, Sony has let users know in a recent FAQ that they’ll compensate their users somehow for the trouble.

The PlayStation EU Blog promises:

“We are currently evaluating ways to show appreciation for your extraordinary patience as we work to get these services back online.”

It’ll be interesting to see what kind Sony comes up with. As a baseline, Microsoft and Electronic Arts have offered free games for outages.

iPhone and PlayStation 3 jailbreaker George “Geohot” Hotz has weighed in on the current PlayStation Network outage stemming from PSN identity theft from unknown hackers in his blog.

He immediately denied having anything to do with the scam, with the reasoning that he’s not stupid, though he doesn’t refrain from taking a potshot at Sony executives:

“To anyone who thinks I was involved in any way with this, I’m not crazy, and would prefer to not have the FBI knocking on my door. “Running homebrew and exploring security on your devices is cool, hacking into someone elses server and stealing databases of user info is not cool. You make the hacking community look bad, even if it is aimed at douches like Sony.”

He continued:

“Also, let’s not fault the Sony engineers for this, the same way I do not fault the engineers who designed the BMG rootkit. The fault lies with the executives who declared a war on hackers, laughed at the idea of people penetrating the fortress that once was Sony, whined incessantly about piracy, and kept hiring more lawyers when they really needed to hire good security experts. Alienating the hacker community is not a good idea.”

Hotz concluded with some words to those behind the scam, again slamming Sony in the process:

“To the perpetrator, two things. You are clearly talented and will have plenty of money(or a jail sentence and bankruptcy) coming to you in the future. Don’t be a dick and sell people’s information. And I’d love to see a write up on how it all went down…lord knows we’ll never get that from Sony, noobs probably had the password set to ’4? or something. I mean, at least it was randomly generated.”

His full blog entry can be found here.

Sony Computer Entertainment Europe has made some leadership changes in response to their in-ability to get things going in the sales department of the PlayStation 3. Gamer’s continue to refuse to believe the PlayStation 3 is in a bad situation by explaining how badly Microsoft’s Xbox 360 is doing in Japan and Europe compared to the Sony console. And, of course, the Wii isn’t competition to Sony.

“Andrew House, Chief Marketing Officer and Group Executive of Sony Corporation, has been named President, Chief Executive Officer (CEO) and Co-Chief Operating Officer (Co-COO) of Sony Computer Entertainment Europe (SCEE) as of May 1, 2009.” (smarthouse.au)

We’ve been told this is the year of the PS3, this is when they bring it all together. Nintendo’s losing some of their grip on the industry with slower sales, even in Japan. The economy isn’t playing nice with any of the consoles and sales continue to drop, reportedly 17% in March compared to last years numbers.

Australia isn’t proving to be any help to Sony, “for example in Australia a consumer can now buy the Xbox 360 for $299 and a separate Blu ray player and DVD upscale player for $199. Combined this is $200 under the recommended retail price for a Sony PS3.”

Here in the United States, we’ve bought more Wii balance boards than PlayStation 3 consoles. One can argue that the Wii is a novelty system but that really casts a dark shadow on the PlayStation 3. The PS3 is being beat out by a novelty item? Can the new SCEE management change the direction of Sony?

There is a bit of confusion regarding the release dates of both M.A.G and God of War 3 for the PlayStation 3. Initially people believed 2009 was the target drop for both titles after a Sony press release mentioned great games being “ushered in” this year following Killzone 2.

The “year” Sony may be talking about is fiscal year 2009… which rolls into March 2010. Although Sony hasn’t tagged either title with an ETA, it’s being assumed that we’re talking 2009 until spring 2010. Given most games launch in the September and October time for the holiday season that leads us to believe it will either arrive for the holiday or slide to 2010. If the title isn’t ready for prime time by the holiday season, can you wait a full year for these games?

More importantly, can Sony?

The best way to build up momentum for the console is to release some hot long awaited titles, M.A.G and God of War 3 seem to be just that product. We now have LittleBigPlanet, KillZone 2 and Metal Gear Solid 4 which were three big hopefuls for the console it would be a huge smash in the face of Microsoft to follow that up with two more one-two punches.

A year seems a bit too far to deliver the blow to their competition. What game are you waiting for on the PS3 and believe will kick unit sales into high gear?

(Thanks, 1up)

While Sony continues to try and persuade gamers that the PlayStation 3 is in a completely different gaming category, statistic gathering companies like NPD put ‘em all in one big basket.

It makes sense for Sony to try to push themselves away from being classified with the Wii console because it makes them look bad. We’re all equal gamers here, there is no need to break into more sub-categories when only three consoles vying for top spot. Many folks (including us) criticize the slow adoption rate of Wii games, yet they steal top software sales spots as well.

Wii — 679,200

Nintendo DS — 510,800

Xbox 360 — 309,000

PlayStation 3 — 203,200

PlayStation Portable — 172,300

PlayStation 2 — 101,200

Thankfully Sony’s PlayStation 3 product took top spot on their hardware list, so that’s not so bad. Sadly, combining all Sony’s hardware still doesn’t meet the units of the Wii.

On the software sales front, Nintendo took six of the top ten positions including position’s one, two and three. Wii Fit takes number one position with an insane 777,000 units sold. The only closest product to Wii Fit was Wii Play (still!) with 415,000 units sold. Place four was held by a 360 title, Left 4 Dead sold 243,000 units.

Although many gamers haven’t turned on their Wii in ages, there is no doubt the market is red hot for Wii. At this point, we’re all wondering how long it will last — any predictions? It’s already been a long time.
