@iPhone Jailbreaking is Fair Use: Digital Media Copyright Act.
Also, since jailbreaking doesn’t allow to create multiple copies of the iPhone or the OS (you’d still need an iPhone to run it), it doesn’t quite break the copyright law.
Derrick, I like your take on it, Apple’s ban hammer has much less weight.
As for being the victim of fraud: I don’t keep the credit card id on my pc. After submitting an order, I clean up the browser cache. Same should apply for portables.
@Kinect:
When somebody says “$150 is Right for Kinect” it means that other people doubt that 😉
I see Kinect having a very slow start. Once it diversifies its game library, it will take down the Wii.
But since I see that happening only after hardcore games come in, this also shows something interesting: Kinect’s market will not be the Wii market, but rather the PS3 AND XBox market. Not sure if that’s a good thing though.
@Lost Planet 2 Tanks: I loved how you guys shredded this one to pieces 😀
@QOTW: Nothing. The video game industry is such a small percentage in the world economy that its influence is just about … none.
As on how the economy impacted my purchasing habits: it didn’t. I’m just facing a total lack of spare time so I don’t game anymore.
The forecast says I’ll have more time in the October – November time frame, so until then no gaming for me.

Hey Derrick & Jennifer
@ Lost planet, I kind of heading towards that it just wasn’t such an awesome game or lack of marketing. I’m associated with a good group of gamers & this game was never brought to topic. The power of the people is the best advertising, I don’t see much from a billboard. Id much rather talk to some1 who has played the game, hear their experience & then watch some trailers/videos to help build my opinion b4 I buy a game. I also agree with derrick, you cant blame the economy when there are games like WOW & MW2 showing that a really good game cant break sale records in a time of financial crisis.
@ Aus game prices (again)
No, Games from local developers aren’t any cheaper in Australia; I still can’t justify the price increase. I blame the government (taxes), it’s also the reason why alcohol is so much more expensive. Due to my area has additional rural taxes on alcohol. I don’t believe developers with be getting a larger cut to sell games to Australia, more than the government are getting their larger cut. Also on the topic isn’t the majority of games/hardware produced & distributed from south East Asia not the US? Hmm im going to do some research of games prices (AUD) sold in the US, Euro, Asia & Aus. Ill submit that comparison sometime later in the week.
@ Tips, something I would suggest maybe cover some more recent game developers/titles in your gaming history/flashbacks. I think it would be cool to see your take a few more newer games (WOW,SC2,RDR, Halo, Kingdom hearts ect…) Though I still greatly enjoy listening to ur cast every week, So keep up the good work, its appreciated =).
Miss ya Don get back on the show the 3 of you make a good team =P

There are two killer apps for Kinect: Dance Central and Kinectimals.
When tween girls saw Justin Bieber rocking out to Dance Central, that immedaitely sold a million Kinect just for that game.
And people who normally don’t care about games were interested in Kinectimals. No, really, Kinectimals seems to be really, really selling Kinect.

Create is nothing like LittleBigPlanet. It’s The Incredible Machine.

Derrick? Nintendo was in 3rd place during the period of Nintendo 64 and Gamecube. The Gamecube was a horrible failure. It was a distant third to the PS2 and the Xbox.
If a company has to die in order to be a failure, then Sony didn’t fail.

I actually agree with derrick, Nintendo is not consider a failure because they made $$$ & stayed afloat as a company ( just weren’t as profitable as their competitors). I don’t think the wii would have been possible if the 64 & game cube weren’t somewhat successful

Sony’s game divsion has failed, company like sony could only survive & afford such losses from the PS3 cuz they have other sources of income.

I always think of the Wii as a glorified Gamecube. The graphics didn’t move on. The only revolutionary thing was the controller.
Hell, people often say that Twilight Princess, one of the platform’s best titles, was actually better on the Cube, as it was designed for that system in the first place.
QotW – I don’t think video game failures are particularly linked to the economic failure. People have continued to buy games throughout the current generation of consoles, and you have to look at record breaking sales of things like Modern Warfare 2 and The Sims to see that consumers are prepared to pay for them, even in the cash-strapped months.
Off topic – Move is going to be released in a few short weeks. The pricing in UK is actually quite sensible. The Camera + Wand box is £45. Those of us that already have a PS Eye can pick up a solo wand for £35. When you consider that is the price for a Dual Shock 3, its not outrageous. Having seen it in demo, I’m actually now considering it.
Kinect is coming in at around 3 times the cost.
Loving the podcast, and glad to have you back to your regular schedule.

^ Calling the Wii a glorified Gamecube is a bit harsh, don’t you think? Sure, it has it’s problems, but graphics aren’t the only way to improve your system.
In a way, the Gamecube was just a glorified Nintendo 64. The only big difference between them that I can think of is the graphics.

Nintendo 64 > PS1. I love the way Nintendo rendered there graphics. They knew there hardware limitations & used cartoon like textures/graphics. This approach looked a lot better than Sony’s attempt to have the best bleeding edge detail. Most of Sony’s games looked edgy/ugly compared to N64.

After my childhood of the N64, i then moved up to the cube. I was happy with the System & the controllers were a huge improvement =). Unforntunatey the cube was the end of Nitendo fanboyism & replaced with the PS2 offering a better gaming experience.
